In the council of our lord King Robert III held at Linlithgow on 20 November [13]99, in which council these lords were present with the king, specially summoned to the king's presence for this, namely: [David Stewart, 1st] duke of Rothesay, [Robert Stewart, 1st] duke of Albany, [Walter Trail], bishop of St Andrews, [Matthew Glendinning], bishop of Glasgow, [Robert Cardney], bishop of Dunkeld, [Gilbert Greenlaw], bishop of Aberdeen, and [Alexander Man], bishop of Caithness, [Archibald Douglas, 3rd] earl of Douglas, Sir James de Douglas, lord of Dalkeith, Sir Thomas de Erskine of that Ilk, Sir Gilbert Kennedy, Sir William de Cunningham, John de Montgomery, [James Biset], prior of St Andrews, [John de Leith], abbot of Holyrood of Edinburgh, Adam Forrester, Mr Walter Forrester, Sir John de Ramornie and Sir William Stewart of Jedburgh, with various others, the present ordinances written below were made and agreed.

First it was ordained that the king will hold his parliament at the monastery of Holyrood in Edinburgh on Monday 10 February next to come, with a continuation of days following.

Item, Walter de Lindsay, compearing before the king, complained to him and the council that he was unjustly captured and made a prisoner by Sir John de Wemyss against justice and the statute of the king and council and the standing of the king. Upon which complaint the king with his council delivered this Walter and his pledges free and quit from every obligation made to the said Sir John de Wemyss by reason of the said capture, and the king asked pledges from the said Walter that the said Sir John shall be unharmed by him and his agency under the penalty of 1,000 merks. And because he did not have pledges ready, he promised the king in the presence of council that he would not depart from him until sufficient pledges had been found. And the king ordained that [Robert Stewart, 1st] duke of Albany should give similar pledges from Sir John de Wemyss under the same penalty that this Walter would be similarly unharmed, and this the aforesaid duke promised to do.

Item, the king by the deliberation of council freed Archibald Stewart from the pledging by which he was obliged to Thomas Boyd, and received pledges, namely, [from] Sir Thomas de Erskine and Sir John Stewart de Innermeath, that this Thomas would be unharmed by this Archibald and his agency, unless by way of law, under the penalty of 1,000 merks, which lord knights arrived at the same Archibald's pledges under the condition, nevertheless, that the same Thomas would find pledges similarly concerning the said Archibald being unharmed.

Item, it was ordained that the king shall write by his letters under the great seal to [Donald], lord of the Isles, that he should compear in his presence in his aforesaid parliament for answering the king and parliament for his brother Alexander, who he had under his keepership and who he freed without the king's consent (which Alexander is reputed a common plunderer and pillager of the kingdom), and for undergoing the determination of parliament in the same place for the said Alexander.

Item, it was delivered that Sir William de Cunningham and Sir Alan de Cathcart, knights, and Hugh Wallace shall compear before the king, [David Stewart, 1st] duke of Rothesay, and their unsuspect council, under the penalty of 2,000 merks at Linlithgow, under forewarning of twenty-one days as a peremptory day, for undergoing the challenge of the aforesaid king and duke to be made against them by the same, and for answering the challenge of Thomas Boyd and his men upon all and singular things which the said Thomas and his men shall relate against the aforesaid William, Alan and Hugh by way of law.
