Acts of the parliament of Robert III king of Scots

The parliament of our lord Robert III, the most illustrious king of Scots, held at Scone on Monday 21 February 1400 [1401] and the eleventh year of his reign with a continuation of following days; with the bishops, abbots, priors, dukes, earls, barons, freeholders and burgesses, and the others who hold in chief of our lord the king, summoned and called in the due and customary fashion.

First, for the honour of omnipotent God, the Father, Son and Holy Ghost, and the glorious Virgin Mary and all the saints and the holy mother Church, the usefulness and quiet of the people subject to him † by God and for protecting the peace in the kingdom, from the common counsel and express consent of all the prelates, dukes, earls and barons and all the other freeholders and of all his community of the kingdom then compearing personally in the same place for this end, or by procurators, he ordained, founded and established the statutes written below, to be observed unshakably throughout the whole kingdom, some for a time, others in perpetuity, as will be evident from the tenor of his statutes following.

Concerning the brieve of inquest

In the said parliament, inasmuch as many of the king's lieges are unjustly disturbed in many ways in their fees and heritages by inquests held in a biased fashion and by ignorant persons, it was decreed that no sheriff or royal officer should cause the execution of any brieve of inquest except in his full court or by his more suitable and worthy bailies, having been summoned and called under a forewarning of fifteen days for this. And that the chancellor should not give sasine of any retour henceforth unless it depones for the person who sought the inquest that the land or tenement contained in the same is in the hands of the king or another lord superior by the death of the person whose heir he claims to be or says he is. And that the said retour should be sealed by the seals of each trustworthy person being on the said inquest along with the seal of the sheriff. It was also decreed that each baron and others holding of the king should have his own seal to serve the king as he is bound to by law, and anyone who does not have one should fall into the king's amercement without remission by an indictment in the presence of the justiciar. And that these should be seals and not signets or signatures as has been customary before this time.

Concerning recognitions †

Item, because many of the king's lieges are troubled in their fees and heritages by arbitrary and secret recognitions of lands by lords superior, it was decreed that no recognition should be made henceforth by our lord, the king, or any other superior lords concerning any lands unless a due and reasonable reason is given why he should cause these lands to be recognosced at the time of the recognition. And that no tenant should lose his possession by such a recognition until the end of a year and a day, provided that he applies his diligence to repledge his lands, recognosced in this way, from his superior lord within the next forty days following the said recognition, if he can find his lord superior. If he cannot find him, let him go to the chief place of the lord with sufficient witness for offering himself prepared to do that which is due in law to his said lord superior concerning the said lands. And afterwards, when he shall come into the presence of his lord superior before the end of a year and a day, he should beg his aforesaid lands to be released at pledge. Furthermore it was ordained that each lord superior making recognition, and each tenant begging his lands at pledge at the chief place, as set out before, shall display the recognition and petition at pledge in the next parish church on the first Sunday after the said recognition at the hour of the great mass when the parishioners have gathered together [and explain] in the vulgar tongue the reason why the recognition was made. And the tenant who begs a recognosced tenement at pledge shall do the same and in the same way if it is denied to him by his lord superior, or if he cannot have the presence of his lord within the prescribed time.

Concerning the donation of the superiority of tenants

Item, as regards grants made by the king to various barons and others of superior station holding their lands of the king himself, it was decreed that, without the consent of the tenant, such a concession or donation, made or to be made, should lose all strength and force. Concerning the complaints of ecclesiastics, widows [and] orphans

Item, it was generally ordained and decreed that the lord king's lieutenant and the rest of the king's officers should be held to hear the complaints of ecclesiastics, widows, orphans and wards simply and plainly concerning any injuries done to them or their own goods, without pledge. And, having heard the complaints, the lord lieutenant or his officer should enquire † if such complaints are found to be just and reasonable. And if they are, the lieutenant or his aforesaid officers should make due and just restoration to the parties complaining without the delay of further process. And such injurers should be punished according to the magnitude of the offence.

Concerning letters of caption and appeals

Item, it was decreed and ordained that the justiciars, sheriffs and other officers of the king should attend to and answer letters of caption to be sent to them by the bishops and their officials and cause due execution of the same according to the manner usual from long ago; notwithstanding any appeals or reasons alleged or put forward to the contrary. Therefore, if any liege of the king believes himself [to be] excommunicated by an unjust process, he should appeal before the end of the forty days following the judgement to the conservator of the clergy, who shall be held to declare the process with his counsel and to put right the injustice. And if it seems to him that the said conservator may not make the right judgement, let him appeal from him to the general congregation of the clergy where henceforth such matters are ordained to be discussed and determined while the schism in the church exists. The clergy have consented to this ordinance during the schism like the rest of the king's lieges.

Concerning the taking of poinds

Item, the lord king decreed generally through the whole kingdom that no-one take poinds without the officers of the king or the lord of the land [being in attendance] except lords in their lordships for their own fermes and debts. And if someone shall disturb anyone's lands by poinding without an officer of the king or the lord of the land as aforesaid, or takes or abducts anything outwith them, that poinding will be adjudged as robbery before the lieutenant or justiciar by indictment or pledge.
